State Specific Privacy Disclosures

Some U.S. states have enacted privacy laws (“State Privacy Laws”) that grant their residents certain rights and require specific disclosures. This notice sets forth those required disclosures.

A. Additional Disclosures

Our Privacy Policy explains how we collect, use, and disclose information about you, as well as our targeted advertising and analytics practices. As required by certain State Privacy Laws, we use the tables below to explain this same information and the categories that they fall under as follows:

In connection with, or during negotiations of, certain corporate transactions, including any merger, sale of company assets, financing or acquisition of all or a portion of our business to another company. Between and among OfferUp, and its current and future parents, affiliates, subsidiaries, and other companies under common control and ownership. If we notify you through the OfferUp Service that the information you provide will be shared in a particular manner and you provide such information. The public (if you post content on the OfferUp Service) and other users (such as when you interact with them through the OfferUp Service). Others at your direction, such as if you enable integrations with the OfferUp service.	Personalize the OfferUp Service and optimize the location and type of offers presented to you when you use the OfferUp Service. Connect you to other users on the OfferUp Service, including via friends lists when authorized by you. Create and maintain a trusted and safe environment on the OfferUp Service, including through detection and prevention of fraud, unauthorized access, intrusion, and service interruption. Conduct investigations and to respond to disputes between users, error resolution, and other similar customer support service. Enable any identification programs we may institute and in which you elect (e.g., TruYou) or are required to participate, such as verifying your identity and address, and to conduct checks against various publicly available databases. Operate, protect, improve and optimize the OfferUp Service, our business, and our users’ experience. Perform analytics, conduct research, and monitor and analyze trends, usage and activities in connection with the OfferUp Service. Communicate with you about products, services, offers, promotions, rewards, and events offered by OfferUp and others. Send you service, support and administrative messages, reminders, technical notices, updates, security alerts, and information requested by you. Comply with our legal obligations or requests from law enforcement agencies, resolve any disputes that we may have with any of our users, and enforce our agreements with third parties. Link or combine with information we get from others, including to help understand your needs and provide you with better service. Assist third-party payment processors with transaction processing, error, chargeback and disputed transaction resolution, and similar payment processing functions. Carry out any other purpose for which the information was collected.

If we collect information that is considered “sensitive” under State Privacy Laws, such as precise geolocation information, we obtain your consent where required by applicable law. We also enable you to exchange messages with other users through the OfferUp Service, which may be considered sensitive personal information under California law. We only process sensitive personal information with your consent or as otherwise permitted by law, and we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.

As described in our Privacy Policy, we collect personal information from various sources, including directly from you, automatically when you access or use the OfferUp Service, and from third-party sources.

We generally retain personal information for as long as you have an account with OfferUp. We may also retain certain information longer, such as information that is the subject of trust and safety matters, or to comply with valid legal requests, or applicable law.

Sales, Sharing, and Targeted Advertising

We disclose certain categories of personal information to advertise OfferUp across the web and in mobile applications, to help us deliver relevant advertising to you on the OfferUp Service, and to help us and our advertisers understand the effectiveness of this advertising. We also disclose certain categories of personal information with select business partners, including data brokers, data marketplaces, and advertising companies for their own and their clients’ use. The information may be used to show you more relevant ads across third-party sites and services or combined with information received from other sources. These disclosures may be considered “sales,” “sharing,” or use of personal information for “targeted advertising” under State Privacy Laws, and the table below provides more information about our practices.

We do not engage in sales, sharing, or targeted advertising using personal information about consumers who we know to be under the age of 18.

B. Your Rights under State Privacy Laws

Opt out of Sales, Sharing, and Targeted Advertising

You may opt out of activities that we engage in that constitute “targeted advertising,” “sharing,” or “sales” of personal information under the State Privacy Laws by:

Mobile App: Depending on where you reside, from within our mobile app, you can opt out of these activities by navigating to the Privacy section of your account settings menu and following the instructions provided. Your mobile device operating system may also include a feature that allows you to opt out of having certain information collected through apps disclosed for purposes described in this section. For example, on iOS devices, you can adjust app tracking permissions, and on Android devices, you can opt out of ads personalization.
Website: Depending on where you reside, you can opt out of ad targeting and sales of information through cookies and similar technologies on our website by logging into your account, clicking on “Account” in the top right corner of the webpage, selecting “Account Settings”, navigating to the Privacy section, and clicking “Edit” under “Advertising preferences”. There, you will find your options to opt out of ad targeting. Your opt-out choice will be linked to your browser only; therefore, you will need to renew your opt-out choice if you visit our website from a new device or browser, or if you clear your browser’s cookies.

You can also opt out by visiting our website with a legally recognized universal opt-out signal enabled, such as the Global Privacy Control.

Access, Correction, and Deletion
You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information.

Nondiscrimination
You have the right not to be discriminated against for exercising any of your privacy rights.

Appeals
If we deny your request, you may appeal our decision by contacting us at [email protected]. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.

Authorized Agents
If you are an authorized agent seeking to make a request to opt out of sales, sharing, or targeted advertising on behalf of a consumer, please contact us at [email protected].

If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request.
